  1. Definitions of terms used
    1. MH&R: Refers to Mövenpick Hotels & Resorts FZ LLC, Dubai, UAE.
    2. "Membership" refers to the relationship of Advantage M members with the participating Movenpick Hotels (a hotel managed by Movenpick Hotels & Resorts FZ LLC or its Affiliates) through the Advantage M programme.
    3. "Members" refer to individual members that have successfully enrolled into the Advantage M programme through individual membership or group membership.
    4. "Group membership" refers to a group of individual members who earn points, on behalf of their companies, that are credited into a group account. In such cases only a nominated member can redeem the points.
    5. "Participating hotels" refers to MH&R properties which are participating in the Advantage M programme.
    6. "Booking" refers to the room reservations that have been confirmed, completed and properly settled.
    7. "Earning" means "collecting" and shall not infer that the points have any cash value until they are presented for redemption. The points cannot be redeemed / exchanged for cash under any circumstance.
    8. "Redeeming" means "utilising" and shall mean that the points have already been consumed, if redeemed.
    9. "Redemption partners" refers to participating retail shops where members can redeem points.
    10. "Date of joining" refers to the date when an approval is sent, by the management of MH&R, to the individuals who have requested a membership with the Advantage M programme.
    11. "Account statement" is the record of the transaction of a member's points through the earning and redemption of points.
  2. Enrollment
    1. Individual membership
      1. Individual membership is awarded once enrollment is approved by MH&R based on the following criteria being met:
        1. The member must be an individual booker in a corporate company or in a travel agency, meaning the member must be an individual who books guests in hotels for and on behalf of his or her employer, for business purposes only.
        2. The member must be at least 18 years of age.
        3. The member's employer must have its registered seat, domicile or branch in a participating country.
        4. Enrolment into the programme occurs exclusively by invitation from MH&R.
      2. Membership in Advantage M is non-transferable.
    2. Group membership
      All points mentioned in point 2.1. apply for group membership with an addition of the following:
      1. The authorized representative of a company will have full company signing rights and will be person authorised to redeem points on behalf of his/her company
      2. Individual members under the group account will have their own individual membership number and username and will be entitled to earn points..
      3. All points earned by individual members within a group account will be credited to the group account and not the individual.
  3. programme restrictions
    1. Employers may prohibit or restrict employee participation in Advantage M. MH&R assumes no responsibility or liability for compliance of members with such policies.
    2. Upon enrollment individuals are informed that participation in to Advantage M will require prior approval from their employers.
    3. MH&R can, at any time, request written proof of approval from the employer for an individual to be granted permission to enroll and benefit from the rewards available to them when participating in the Advantage M programme.
    4. Each individual or group wishing to participate in the programme will be responsible for gaining approval from their employer, to participate in Advantage M.
    5. Participation in the programme and the awarding of incentives are void if prohibited by law and will be subject to any applicable government regulations, current or future.
    6. Employees of MH&R, its affiliates, or hotels managed by it, or Procco Financial Services or its affiliates, are not eligible to participate in Advantage M.
    7. Online travel agents, tour operators, event organizers and conference agents, wholesellers and DMCs are not eligible to participate in advantage M.
  4. Changes to Advantage M and termination
    1. MH&R reserves the right to change terms and conditions of Advantage M by providing written notice of 30 or more calendar days, duly posted on the Advantage M website, or by notification in writing sent to all active members.
    2. MH&R reserves the right to terminate part of Advantage M or the whole of this programme by providing written notice of 30 or more calendar days, duly on the Advantage M website, or by notification sent to all active members, via written notice. No further claims for points will be accepted after the date of termination and any claims made but not approved by that date will be deemed invalid and declined.
    3. Members may redeem earned points for rewards up to 30 calendar days after the date of the termination. Points not redeemed thereafter will be forfeited.
    4. MH&R reserves the right to amend, update, change or delete points at any time if it determines that these points have been credited in error, even if such changes may affect the balance of points already collected by the member.
    5. MH&R may accept or reject any application for Advantage M membership, at our sole discretion. .

    6. MH&R has the right to terminate the Advantage M programme at any time. MH&R will make reasonable efforts to give you prior notice of the termination of the Advantage M programme.

  5. Cancellation of membership
    1. MH&R, at its sole discretion, may cancel any membership and revoke any and all unredeemed points collected by any member for reasons that include, but are not limited to:
      1. Violation of any terms and conditions of the Advantage M programme.
      2. Misrepresentation of any information or any misuse of the Advantage M programme.
      3. Violation of any national, state or local law or regulation in connection with the use of membership benefits.
      4. Failure to pay the hotel charges by the Company within agreed dates.
      5. Fraudulent activities or abuse involving any portion of this programme.
      6. More than one active account per member.
      7. Enrollment without prior approval from the employer.
      8. Action, in any other way, to the detriment of the programme, as may be determined by MH&R in its sole discretion.
      9. Any membership that is deemed an inactive/lapsed account.
    2. Cancellation hereunder will be forthwith, by simple notice of MH&R to the member concerned, and all points earned will be forfeited.
    3. programme violations, fraud or abuse are subject to appropriate administrative and/or legal action by appropriate governmental authorities and MH&R.
  6. programme interpretation
    1. Interpretations of Advantage M terms and conditions shall be at the sole discretion of MH&R. The decision of MH&R is binding on all matters concerning the programme.
    2. Neither Advantage M nor any benefit offered by Advantage M creates, constitutes or gives rise to any legal or contractual rights by members against MH&R.
    3. Any accommodation or other services booked, for which points are claimed and awarded are subject to the Participating Hotel's terms and conditions.
    4. The programme may not be used in conjunction with any other promotion or external rewards programme.
  7. programme communications
    By enrolling into Advantage M and accepting the terms and conditions members thereby authorise MH&R, and its affiliates and subsidiaries to collect, process and use the data provided for any business-related purpose including marketing and communications with members via electronic direct mail, newsletter and SMS in direct relation to the products and services offered by MH&R and Advantage M.
  8. Membership Validity
    1. A membership year is valid from January 01st until December 31st of each year, regardless of the member's enrolment date.
    2. Membership cards are granted and valid throughout the membership year, and are automatically renewed should the membership account remain 'active' as defined in the following point.
  9. Active and lapsed accounts
    1. An active member is defined as any individual or group, earning or redeeming points within the previous 6 months.
    2. Any account for an individual or group member that has not had any activity (earning and/or redemption) within a six month period will be treated as a lapsed account.
    3. Members may, with the approval of MH&R, re-activate their lapsed account, but the previous points balance will not be re-instated.
    4. Any account which remains inactive for 12 consecutive months will be deemed to have expired and any unredeemed or unclaimed points will be void.
    5. Any card shall be blocked temporarily or permanently or will be deactivated in case of card loss or membership termination by MH&R.
  10. Earning points and adjustments
    1. Any Points earned within a membership year will expire on January 31st of the following year.
    2. The booker who books up to 30 nights, he will earn 1 point for every US$1 he/ she spends, when booking rooms.
    3. The booker who books above 30 nights, he will earn 0.5 point for every US$1 he/ she spends, when booking rooms.
    4. Accreditation of points is granted to membership accounts 30 days after the settlement of the booking.
    5. Points may not be purchased or sold and are not transferable.
    6. Points listed in account statements will be displayed to reflect the USD value for convenience only.
    7. For any disputes on points credited, members are requested to keep track of the confirmation number of all reservations made.
    8. Point adjustments will not be made after 90 days from the day of the settlement to which the claimed points relate.
    9. In the event of a dispute between members who claim points for the same event, MH&R will decide, in its sole discretion, to which member points would be allocated.
  11. Earning exclusions
    The following booking will not be eligible for Advantage M points:
    1. Complimentary stays.
    2. Bookings made via online travel agency or wholesale vouchers.
    3. Reservations paid for with airline vouchers and airline crew accommodation.
    4. Reservations made through redemption of any programme outside of Advantage M.
    5. Bookings made with Advantage M points.
    6. Volume agreements for bulk rooms purchased at negotiated rates.
    7. Cancelled bookings and/or no shows will not qualify to earn Advantage M points. Points will only be awarded for services consumed.
  12. Redeeming points
    1. Redeemed points are deducted from the member's balance and can no longer be reused.
    2. Points are redeemable in all participating MH&R properties and redemption partners, and can also be exchanged for gift vouchers as indicated on the Advantage M website.
  13. Exchange rate
    1. The rate of exchange used for the conversion of the qualifying spend in a local currency into US Dollars, for the purpose of calculating the number of points to which a member is entitled to, will be available on the Advantage M website.
    2. Such currency information is believed to be accurate, but MH&R do not warrant or guarantee such accuracy. The calculation of the number of points on the basis of these currency exchange rates is final and binding on members and cannot be challenged.
  14. Limitation of liability
    1. MH&R, its parent company, subsidiaries, affiliates, directors, employees and agents make no guarantees, warranties or representations of any kind, express or implied, with respect to rewards, and shall not be liable for any loss, expense (including, without limitation, attorneys' fees), accident or inconvenience that may arise in connection with the use of such rewards or as a result of any defect or failure of such rewards.
    2. Any implied warranties of merchantability or fitness for a particular purpose are specifically disclaimed.
  15. Tax liability
    1. Points or rewards received through participation may be subject to tax liability in certain countries. All tax liability, including and without limitation, disclosures connected with the receipt and/or use of points or rewards, is the sole responsibility of the member.
  16. Redemption partners as independent contractors
    1. Redemption partners are independent contractors and nothing herein or in any other materials related to the programme is intended or shall be construed as establishing any agency, membership, partnership or joint venture relationship between MH&R and redemption partners.
    2. MH&R, its parent, subsidiaries, affiliates, franchisees and agents are not responsible or liable for the conduct of redemption partners and/or their programme or services, including and without limitation any changes or discontinuances of their services or the delivery of products or services offered by them.
  17. Hotel rewards
    1. "Hotel Rewards" offer discounts when there is a redemption of Advantage M points for restaurant bills at participating hotels across the Middle East, or for room reservations booked on public rates at participating hotels across the Middle East, Europe, Asia and Africa.
    2. The number of Advantage M points required for 'Hotel Rewards' varies among the participating hotels.
    3. "Hotel Rewards" room reservations must be made in advance and is subject to availability at the time of booking. Room discount will not apply during peak periods by destination.
    4. "Hotel Rewards" room reservations should be made by calling the Central Reservation Offices or by completing the Advantage M Travel Request Form on the website. Failure to comply with the procedure may result in cancellation of reservations.
    5. "Hotel Rewards" room reservations must be settled with Advantage M points and room discounts will not be applicable unless a valid, activated Advantage M membership number is provided in the Advantage M Travel Request Form.
    6. Amendment or cancellation of an existing 'Hotel Reward' room reservation is not possible once the booking is confirmed and the Advantage M points have been deducted from the member's account.
    7. Members will not earn Advantage M points for 'Hotel Rewards' stays.
    8. 'Hotels Rewards' on restaurant bills are only applicable when a valid, activated Advantage M membership card is presented at the time of dining and applies to a maximum group of six people.
    9. 'Hotel Rewards' on restaurant bills are not applicable on room service and during black-out periods such as New Year's Eve, Valentine's Day, Christmas Day and Easter.
